According to TMZ.com, the lawyer for the country singer and reality TV star sent Vivid a cease and desist letter that claims the tape was “never intended for sale or public distribution.”

Vivid’s tape, titled Mindy McCready, Baseball Mistress, is said to include footage of the singer talking about her sexual exploits with former Major League pitcher Roger Clemens, among other high profile celebrities.

According to the report, the lawyer believes Vivid does not have the right to distribute the tape that McReady claims was stolen from her home three years ago.

Vivid executives were unavailable for comment at press time.

This is the second time Zero Tolerance’s take on the popular MTV reality show has made TMZ. Just a couple weeks ago, TMZ cameras visited the set of the porn parody, and aired this segment about it.

Zero Tolerance contract girls Kagney Linn Karter and Sara Sloane were both on hand for this latest brush with the paparrazi, which sources at Zero Tolerance say involved their getting “hushed by patrons all around them for causing general mayhem all evening.”
